    This session will discuss a wide range of ethics issues, especially those that have arisen during the pandemic as a result of remote working and other changes in the manner in which lawyers work. Topics will include attorney-client confidentiality, conflicts of interest, UPL questions raised when lawyers work remotely from a jurisdiction in which the lawyer is not licensed, and others. The session will include discussion of ABA model rules, including Model Rules 1.1, 1.6, 1.7, 5.1 and 5.5.

    1. After attending this session, meeting attendees will have mastered the skill, among other things, of (1) thinking through the ethics issues that arise in extreme situations, like data breaches and disasters, and (2) applying the ethics rules in complex situations related to preservation of confidentiality and the attorney-client privilege.
    2. After attending this session, meeting attendees will have learned, among other things, to (1) navigate the issues around sharing confidential information with aligned third parties, like insurers and public relations advisors, and (2) put the necessary measures in place to minimize the ethical problems that can arise when client confidentiality or office technology are compromised.
