The Attorney General of the United States recently announced the Department of Justice's "Combatting Redlining" Initiative. The initiative, which was announced jointly with the leaders of the CFPB and OCC, will focus not only on traditional theories of redlining but may also signal a crackdown on "digital redlining disguised through so-called neutral algorithms," in the words of CFPB Director Rohit Chopra. It may also point toward emerging theories of redlining, as indicated by Acting Comptroller Michael Hsu's remarks that regulators will think "more expansively" about what constitutes redlining. This panel will explore these initiative, novel theories of redlining, and other current fair lending issues."
