    Prosecutorial expectations continue to play an important role in internal investigations, although private sector lawyers and prosecutors must carefully manage that relationship to maintain privilege and avoid state actor and constitutional concerns. Further, the explosion of technology, including cloud services, cross-border data arrangements, and bring-your-own device policies can necessitate the greater use of non-lawyer experts and raise privilege, privacy, and employment issues. Finally, financial services remains a heavily regulated industry, and appropriate management of the supervisory and regulatory relationship is critical in many internal investigations. This panel will address the ethical issues that in-house, private sector, and government lawyers must consider when conducting an internal investigation or using its results
