The last few years have seen a surge in emerging contaminants enforcement and toxic tort litigation. This panel will explore some forces behind the acceleration in emerging contaminants litigation and the different directions enforcement litigation in this area are likely to go in the next few years. While there has been bipartisan interest in further regulation of PFAS and ethylene oxide (EO) at the federal level, the states have moved more quickly in litigating against companies historically linked to these contaminants. Panelists will discuss how environmental enforcement is likely to be shaped by major new developments in federal regulation of emerging contaminants that are expected in the next year including the listing of PFOS and PFOA as hazardous substances under CERCLA, new NESHAPs for industries producing EO (including the medical sterilization industry) under the Clean Air Act, and the Fifth Unregulated Monitoring Contaminant Rule (UCMR5) (which covers a large group of PFAS chemicals) under the Safe Drinking Water Act. The panel also will address which industries are likely to be enforcement targets as EPA and the states focus on these contaminants.
