In his Plan to Secure Environmental Justice and Equitable Economic Security, then-candidate Joe Biden committed to pursue environmental criminal cases to the fullest extent permitted by law, and to hold corporate executives personally accountable. With the nomination of the Justice Department's former environmental crimes prosecutor to lead EPA's enforcement office, criminal enforcement of environmental laws is likely to be a key focus of the Biden-Harris agenda. Panelists will review and discuss recent policy announcements from both DOJ's Environment and Natural Resources Division and EPA, including a directive to the criminal program to strengthen detection through the use of mapping tools. How will EPA leverage these tools and other advancements in technology, including drones and smart phones to facilitate the development of criminal cases? Will there be sector-focused initiatives given the emphasis on climate change and environmental justice? Finally, this panel will explore how DOJ and EPA are apt to be partnering with new and different agencies to bring a whole-of-government approach to environmental criminal enforcement.
