The new reality is that doing business, and especially franchising, in California and Washington presents unique challenges. Legal and operational issues ranging from data privacy, joint employer, non-competes, AB-5 and its progeny, the gig economy, anti-poaching, negotiated sales, and the likelihood of aggressive state enforcement, all result in franchisors having to carefully consider the pros and cons of entering the lucrative California and Washington markets.
