Class, consolidated, and other mass actions are litigation vehicles that, in many circumstances, allow franchisees to exert more pressure, both economic and reputational, on a franchisor. These actions present special requirements and challenges for both sides. This program will discuss the tactical and procedural challenges of pursuing claims through multi-party actions. In addition to discussing drafting and enforce ability of class action and mass/collective action waivers in court and in arbitration, and common class, joinder, and classification issues, the presenters will suggest practical ways to manage these cases economically and move them towards resolution through either motion practice, settlement, or trial, as well as the practical and ethical concerns that may arise for plaintiff's counsel when representing groups of franchisees who may have or develop divergent interests.
