The Department of Labor proposed regulations that would specifically permit ERISA plan fiduciaries to take into account environmental, social and governance matters in making investment decisions and generally would require plan fiduciaries to vote proxies. Plan fiduciaries should understand how this proposed guidance will impact their fiduciary duties if the guidance is finalized in the current form. This panel of experts will review the history of the DOL's guidance on ESG considerations and proxy voting matters and will discuss whether the proposed regulations, if finalized, are likely to change plan investments.
