    Social media continues to be a valuable tool for providing information and advocacy regarding environmental, energy, and resources issues, but what are the ethical responsibilities of lawyers, government and private, with respect to the use of social media? This panel will discuss a lawyer's ethical responsibilities-and examine potential pitfalls-with respect to using social media as an advocacy and investigative tool, including the application and scope of the attorney client privilege, the engagement of public relations specialists to assist in the advocacy of a client's position, and possible conflicts issues. The panel will further explore preserving social media evidence and spoliation issues, contact with represented and unrepresented persons, and how a lawyer should be advising clients regarding the use of social media. The responsibilities under ABA Model Rules 1.1, 1.6, 1.9, 3.6, 4.1, 4.2, 4.3, and others will be discussed.

    Learning Objectives

    Analysis and evaluation of the Model Rules with respect to a lawyer's duty of competency, confidentiality, and not to be deceptive when utilizing social media as an investigative and advocacy tool in an environmental, energy, or resources matter (Model Rules 1.1, 1.6, 1.9, 3.6 and 4.1);

    Knowledge on how to avoid waiver of attorney-work product doctrine protections and attorney-client privileged communications when using social media or a public relations specialist and the exceptions to the duty of confidentiality (Rule 1.6); and

    Analysis of the Model Rules requirements in counseling the client regarding online communications, including posts, blogs, Twitter, and Facebook entries (Rule 1.1).
