The purpose of a mediation is to resolve a case or at least bring the parties closer together. Sometimes, despite agreeing to mediation, a party may choose to use the process to achieve an improper advantage or may come to mediation without any real intent to engage in an attempt to settle. This program will explain what can happen when parties come to a mediation in bad-faith and what a mediator can (or should) do under such circumstances. Further, the panel will discuss differences in rules when the mediation is required by court rule.
