    APIs have existed for decades, but the term has become one of many common buzzwords in recent years. APIs are Application Programming Interfaces, and they establish standards for connections between software that sends data and software that receives it, serving the function of translating the data so that it can be properly interpreted and processed. Many businesses build APIs for accessing their software, while others utilize third party APIs to access certain data. But are APIs proprietary? Can the proprietor of software which has one or more APIs control who can access and use those APIs? Can it block another party from copying some or all of its API documentation or code? Can API documentation or code be the subject of open-source licenses, and can it mandate open-source licensing of broader software products? What risks are associated with establishing and using an API in the United States? Can an API be patented? What risks if any are associated with using API as all or part of a trademark? This session will explore the intellectual property rights associated with APIs to aid counsel in advising clients on the establishment of new APIs, the borrowing of API code or documentation from others, and the use of third-party APIs.
