All federal courts of appeals and most state appellate courts now have mediation programs in place. Despite these many formal appellate mediation programs, negotiating a settlement once an appeal has begun is a challenge, and success rates lag mediation success rates at trial courts. The appellate process can often further entrench the parties, and their counsel, in their litigation positions. Just as appellate advocacy demands a different way of thinking than trial practice, appellate mediation requires mediators to acquire understandings, skills, and personal qualities be effective.
In this webinar, two highly experienced appellate mediators, Brendon Ishikawa and Dana Curtis, who are co-authors of Appellate Mediation: A Guidebook for Attorneys and Mediators (American Bar Association 2016), converse with appellate attorney and mediator Steve Emmert about strategies that they have found successful in assisting parties to resolve disputes during the appellate phase.
