Copyright Litigation Strategies
This program will explore the critical issues in ERISA benefit claims litigation, with a particular focus on disability benefits. Among other things, this panel will discuss: when “objective evidence” is required to support a disability benefits claim; the evolving case law on pre-existing conditions; the implications of noncompliance with the claims regulations in litigation for plan administrators; an update on attorneys’ fee awards; and anticipated issues related to COVID-19 and disability benefits claims. This session is an encore presentation from the ABA’s Section of Labor and Employment Law Employee Benefits Committee Mid-Winter Meeting.
