In the Western United States, the effects of climate change are already readily apparent, and projected to grow into the future. Resilience to these effects, as experienced by both natural systems and the built environment is critical. This panel will explore three important challenges the West faces and how the law may promote resilience among these systems. Panelists will first consider resilience in the availability and distribution of fresh water supplies, long a dominant force driving the development of the West, and how climate change poses new threats to water supply and to existing and planned water infrastructure. Next, reflecting on the catastrophic energy grid failures in recent years in Texas and California have experienced, panelists will highlight key legal and policy issues that must be addressed to ensure that energy storage and transmission infrastructure can withstand increasing stress resulting from climate change. Finally, the panel will focus on wildfires and resiliency, as the West is bracing for another dangerous wildfire season while still recovering from record-breaking fires in Colorado, Oregon, California, and other Western states in 2020.
