Since 2000, more than one hundred countries have enacted new mediation laws, creating a rapidly growing and widespread legal framework for the use of commercial mediation worldwide. In 2019, 51 countries, including the United States, China, and India, signed the Singapore Convention, further paving the way for more widespread understanding and application of mediation as a primary dispute resolution tool. And now, against the backdrop of growing political and socio-economic uncertainty and rapidly changing business practices within and post-pandemic, mediation emerges as a most fitting tool for maintaining relationships, managing risk, and resolving disputes before they escalate further.

The panel will discuss recent trends in the globalization of mediation, including:

    • Developments, opportunities, and challenges in international mediation.
    • The role of ADR institutions in supporting the use of mediation and collaborative dispute resolution mechanisms.
    • What every businessperson, lawyer, and ADR professional needs to know about alternative dispute resolution in the context of the Singapore Convention.
    • Emerging trends in Online Dispute Resolution at the international level.
    • The role of mediation in arbitral processes, and what arbitrators' roles are as settlement facilitators.
