Discovery by Design: Protecting Data in U.S. Legal Proceedings
In an adversarial system, data protection can become one more bargaining chip in discovery negotiations. Especially in asymmetrical litigation, one party may perceive that its right to evidence is compromised by another's requests for data limitations and security measures. Yet data privacy and security are universal concerns affecting all parties. Transposing old concepts of what constitutes a "document" on modern data routinely results in over-production, increasing risk and driving up costs. Embedding data protection principles in discovery processes fosters the just, speedy and inexpensive resolution of disputes while allowing for compliance with data protection obligations and reducing cyber incident risk. This talk advocates for reimagining discovery, taking privacy into account and leveraging technology to make data protection a baseline consideration and the discovery norm.

A Primer on Privacy and Data Protection Law and Regulatory Developments in the Middle East and Africa
The emerging economies of the Middle East and Africa are rapidly catching up with other parts of the world in terms of data privacy regulation with a burgeoning landscape of new laws, regulations and regulatory bodies across the region. Despite dealing with the COVID pandemic over the last 18 months, Africa continues to offer growth opportunities fuelled by increased connectivity and many parts of the Middle East have continued to invest in transformational government initiatives such as the Neom smart city development and other mega-projects in Saudi Arabia. This talk will cover developments including new data protection laws or guidance in Egypt, Kenya, Qatar and the UAE; draft or interim legislation in Saudi Arabia, Pakistan, Namibia and Nigeria; and some of the regional arrangements being implemented in Africa to standardise principles of data protection and ensure the free flow of information.
