Over the last couple of years, numerous U.S. Federal Circuit Courts of Appeal have addressed the question of whether 28 U.S.C. 1782 permits U.S. discovery in support of international arbitrations. Some have concluded that it does, and others have concluded that it does not. A clear split among the Circuit Courts of Appeals has emerged on this issue and the Supreme Court may intervene to finally resolve it. This program's expert panel will review the most recent cases, discuss what effect the recent decisions authorizing discovery will have on international arbitration practice, and consider the prospects of Supreme Court intervention.
