Take-Offs and Landings: Ethical Risks in Initiating and Terminating Attorney-Client Relationships [CC]

Lawyers are often hired by clients for their expertise in a particular area of law. In that way, lawyers may be aware of the standard of care or the risks of the type of law that they practice. But there can be significant risks for lawyers in the way in which they initiate and terminate attorney-client relationships. Indeed, lawyers can face risk that would not otherwise exist -- or lawyers can inadvertently exacerbate existing risk -- depending on whether they adopt appropriate risk management techniques in opening and closing files.

In this program, participants will learn practice tips for opening matters, including managing conflicts, what to include in engagement letters, and how to "screen" potential problem clients. Participants will also learn practice tips for closing matters, including when a lawyer can withdraw (and when they should), what to include in a file-closing letter, and how to navigate an early exit. This program will also focus on the potential negative outcome for attorneys who are not cognizant of these risks, and how these issues could manifest in a future malpractice claim.

Tune in as a panel of experts discuss practical considerations, malpractice claim risks, ABA Model Rules 1.2, 1.7, 1.9, 1.16,1.18, and beyond. Alanna Clair, Partner, Dentons, will moderate and discuss attorney-client relationships with David Lefkowitz, The Lefkowitz Firm LLC, and Alison Buchanan, Shareholder, Hoge Fenton.
