The Supreme Judiciary: October Term 2022
While all attorneys are subject to their home ethics rules, they are also subject to the ethics rules of the foreign forum in which they appear. How are conflicts resolved? In addition, different jurisdictions have different approaches to attorney client privilege, particularly when it comes to in house counsel. How are those concerns resolved? These and other ethical pitfalls and risks facing attorneys engaged in cross border transactions and litigation's will be addressed.

Historically, oversight over legal profession remains local; yet, practice of law now often involves cross border transactions and disputes, raising complex issues of lawyers' ethical obligations. Should counsel in Europe working on a deal governed by US law be concerned about US ethics rules? How can attorneys avoid engaging in UPL while representing clients in cross border matters? Are in house and outside counsel in other jurisdictions subject to the same ethics rules? What are major differences in ethical standards between US and other jurisdictions (communicating with represented parties, confidentiality, attorney-client privilege, preparation or examination of witnesses). Finally, ethical issues involving multi-jurisdictional law firms will be discussed - e.g., conflicts rules, training, compliance and enforcement, as well as specific ethical pitfalls or risks that lawyers are facing as result of COVID-19 crisis.
