Since the implementation of GDPR in 2018 and the completion of the Brexit process in 2021, cross border litigation in U.S. and U.K. courts has highlighted the conflict certain companies encounter when discovery obligations in those courts and in regulatory proceedings may mean a choice between compliance with U.S. and U.K. court orders and rules and sanctions in their home jurisdictions, and vice versa. In addition, privilege challenges abound where privilege may not lie in communications with in-house counsel in jurisdictions outside the U.S. How can one have electronic information from outside the U.S. or U.K. admitted into evidence while adhering to the privacy requirements and navigating privilege issues? This program offers insights into and practical suggestions for approaching and resolving to these issues.
