2:45-3:45pm New Trends in Digital Evidence and Their Effect on Matrimonial Litigation
Issues involving digital evidence (ESI) are not new in matrimonial practice ��� but evolving technologies require special consideration. The use of WhatsApp and other forms of encrypted messaging have increased dramatically. Ring, Nest and other video devices and services have become commonplace in many homes. iCloud computing is fast becoming the 'rule' ��� not the exception for individuals ��� not just businesses. Bitcoin and other cryptocurrencies have gone mainstream ��� and provide a very effective means for litigants to hide assets and engage in 'secret' transfers of funds. Whole Drive Encryption is now common on consumer grade computing devices, requiring special consideration for any potential e-discovery demands. iCloud and similar services may be very convenient ��� but they are also a leading source of data compromise in cases of 'digital espionage' between estranged spouses, and their children. This program will address all of these issues from the perspective of family law litigation.
