1:00-2:00 p.m
Welcome Remarks (3 minutes): Charley Drummond, Chair, Workers Compensation & Employers Liability Committee
The State of the (Dis)Union in Workers' Compensation Nationwide
Major issues and influences are affecting the workers' compensation industry today, and the response of the jurisdictional regulatory worlds has been diverse and wide ranging. Facing issues such as legalized marijuana, opioids, evidenced-based medicine, and pharmaceutical formularies; as well as a movement toward advocacy-based claims and inclusion of psycho-social considerations, what exactly is the state of our union when it comes to managing workers' comp? Can all the stakeholders and state regulators find a common path to the challenges before us, or are we headed to an even broader state of dis-union? These are the issues that our esteemed panelists will address.

Evolving Workers' Compensation Issues Regarding Safe Returns to Work, Treatment, and Disability Associated with the COVID-19 Pandemic (1 hour)
The COVID-19 pandemic has continued for almost one year, at present. The pandemic has affected all aspects of life but especially work life. Although much remains to be learned, during the past year, information has been gathered regarding how to keep workers safe, how to effect a safe return to work, medical treatment for workers who are afflicted with COVID-19, and how to assess causation and disability for workers afflicted with COVID-19. Our panelists, which include a physician who specializes in occupational medicine and a physician who specializes in frontline treatment of individuals suffering from COVID-19, along with attorneys representing both employers and injured workers will attempt to provide insight and helpful information on which factors will be important to physicians in determining the likelihood that a worker has contracted the disease at work, what should be done to protect the safety of all workers in this world where sustained community transmission is still active, and additional ways to protect those in the workforce. The panel will also discuss issues involving disability resulting from COVID-19 including both temporary and permanent disability and issues involving specialized treatment needed by workers suffering from COVID-19. The panel will address at least three different factual scenarios and pose questions to the physicians based on each scenario. Attendees will be given an opportunity to pose questions directly to the physicians and attorneys after the initial presentations regarding the factual scenarios have been presented.
