Pandemic or not, criminal jury trial will commence and proceed to verdict, at least on a "remote" or virtual basis. Those trials will present issues related to, among other things, the Sixth Amendment rights of defendants to "public" trials and cross-examination of witnesses, the scope and extent of public access to trials, the First Amendment right of access, and the selection of jurors. This two-part program will address these and other issues ��� and consider how criminal jury trials might be conducted in the future ��� using the trials in Minnesota of four former police officers prosecuted for the detention and death of George Floyd. Learning objectives include:
- Provide an overview of how State and federal courts are dealing with jury trials during the pandemic
- Using a case study, describe issues that may arise with remote trials
- Examine how health and safety concerns might affect stages of remote jury trials
- Appreciate constitutional challenges to remote jury trials
