    In 2020's Maui decision, the Supreme Court created a new test for determining when Clean Water Act (CWA) jurisdiction attaches. Permits are now required where discharges through groundwater are the "functional equivalent" of point source direct discharges into surface waters. While the Court detailed some bounds to these reviews, the complete picture was largely remanded for further proceedings. Over the past year, Maui decision ramifications have been percolating into agency decisions on permits and into citizen suit enforcement actions across the nation. Join panelists as they discuss Maui impacts on surface water programs (including permit programs, TMDLs, and stormwater management), where Maui may intersect with state groundwater programs, what's next for federal agencies, and whether the Court's new "functional equivalent" test is reshaping Clean Water Act enforcement.
