In 2020, numerous regulations to implement various aspects of the Foreign Investment Risk Review Modernization Act of 2018 (FIRRMA) were enacted that significantly expanded the scope and powers of the Committee on Foreign Investment in the United States (CFIUS). Among other things, these regulatory changes established mandatory filing requirements relating to transactions involving certain technologies and augmented the ability of CFIS to review deals involving sensitive personal data and specified kinds of real estate. During this program, a panel comprised of government attorneys, in-house counsel, and private practitioners will evaluate how CFIUS has used its new powers (e.g., the TikTok matter), and they will offer insights on best practices for doing deals involving CFIUS.
