This Program will discuss emerging and changing issues in Directors & Officers Liability Coverage, including discussion of the 9th Circuit's recent decision that excess insurers generally may not avoid or reduce their own liability by contesting payments made by underlying insurers, unless the payments were motivated by fraud or bad faith. The Panel will also discuss recent decisions applying Interrelated Wrongful Acts, the "bump up" exclusion, and the "dual capacity" exclusion. Finally, the Panel will consider the recent spate of lawsuits brought against companies and their directors and officers arising from the Covid-19 pandemic.
This panel will discuss the following common yet complex coverage issues in bankruptcy cases: a tort claimant's' ability to access liability insurance proceeds; the individual insured's ability to access D & O insurance proceeds; the impact of the debtor not satisfying self-insured retention on coverage; the bankruptcy court's jurisdiction to resolve coverage issues; and insureds and general creditors' objections to policy buy back or coverage in place agreements as part of a plan of reorganization.
