This will be an interactive panel discussion comprised of a plaintiff's attorney, defense attorney, a communication/professional speaker expert and myself, a Mediator and former practicing attorney. All of the presenters have already gone forward with countless settlement discussions, court appearances, meetings and presentations on-line since the pandemic began. The panel will discuss the difference between in-person negotiation and presentation skills in comparison to the virtual world. In addition, as people are now wearing masks when in-person mediations go forward or when they are in the same room as other people while going forward with a mediation on-line, there are absolutely means and methods which allow certain people to be more effective in presenting their case and making arguments in order to ensure successful negotiations. The panel would provide recommendations, including specific examples, of means and methods that attorneys as well as their clients and experts can do in order to ensure their success. This would include additional preparation, tone, mannerisms, eye contact, tactics to help develop relationships, lighting, repetition and other skills which help maximize the person's message and arguments to the other side and/or neutral in the best possible manner.
