In January 2019, the ABA House of Delegates approved a resolution co-drafted and co-sponsored by the Dispute Resolution Section on the Appointment and Use of Special Masters in Federal and State Court Litigation. This program follows on work of the ABA Pandemic Task Force and the Judicial Division to adapt the Guideline's principles (recommending that courts consider making more creative use of special masters) to examine how courts can make use of special masters to assist with the demands of the pandemic. There are immediate issues (such as how to provide justice safely at a time when building access is limited and keep cases moving even as trial dates may need to be delayed); and there are also impending issues (such as how to handle eviction case filings when moratoriums are lifted, or bankruptcies arising from the pandemic when they are filed, while dealing with existing cases). And to confront them, the effort has generated new ideas, never before used for judicial administration, and a new way of thinking about how ADR can be used to assist as a problem-solving means for courts.
