When COVID 19 forced the courts to re-think their environments to ensure that cases could continue to be resolved while observing necessary restrictions due to the pandemic, judges, lawyers, and court administrators worked collectively to find creative and novel solutions. In many jurisdictions that involved the use of technology and the creation of the "Virtual Court", using various platforms and tools. For decades, the in-person courthouses had posed unique challenges for persons with disabilities. Everything from courts with stairs, revolving doors and without assistive tools needed for persons with disabilities were the norm. This program will explore the issues that persons with disabilities of various types face in the new normal of the Virtual Courtroom. What tools works well, and what challenges are there for those with disabilities -- both lawyers and clients. Can technology be a solution going forward.
Our panel includes judges and lawyers with disabilities, as well as technology smart practitioners. They will cover these topics:
1. What tools work well and what are the pitfalls of using technology for attorneys and clients with disabilities?
2. What advantages do virtual courtrooms provide in ensuring equal access to justice?
3. Are there ethical considerations that lawyers and judges must consider in relying on virtual courts particularly when the attorney or client is a person with a disability.
4. How do you accommodate deaf, blind and hard of hearing clients in a virtual trial and why does that matter?
5. Are there reasons to incorporate technology based trials into the courts to assist persons with disabilities after the current crisis ends.
