Model Rule of Professional Conduct 1.1 mandates lawyers who take on an immigration matter provide competent representation. Competence under the Model Rules requires an attorney to have the requisite knowledge, skill, thoroughness, and preparation for the matter. Additionally, the life-altering consequences of a lawyer's failure to act diligently as required by Model Rule 1.3 and to communicate with the client as required by Model Rule 1.4, means that lawyers must be especially careful in immigration representations. Finally, a lawyer's duty to protect a client's interest, even when the lawyer must withdraw from the matter, presents the immigration practitioner with concerns for the client's continued welfare and safety. (See Model Rule 1.16)
