Electronic information is a common feature of criminal investigations and proceedings. State and federal courts across the Nation, including the United States Supreme Court, have addressed the circumstances under which the Warrant Requirement of the Fourth Amendment or its State equivalents might apply to government requests for electronic information. Courts have also addressed the Fifth Amendment implications of compelling a person to provide a password or furnish biometric data to unlock cell phones or other encrypted devices. This webinar will explore the applicability of the amendments to such government requests.
