ERISA Survey of Federal Circuits, 2024 Edition
ERISA comprehensively regulates fiduciary conduct und pension and welfare plans for the employees of private U.S. companies. Our panel will take us through ERISA's general prudence and other fiduciary principles, the rules governing prohibited transactions (including under corresponding provisions of the tax code), the "plan assets" regulation that controls whether an entity may be considered to be subject to ERISA by virtue of plan investment, and the trust, "indicia", bonding, and exculpation rules.
