On September 24, 2020, the U.S. Department of Housing and Urban Development ("HUD") issued its final rule regarding HUD's implementation of the Fair Housing Act's ("FHA") disparate impact standard. 85 Fed. Reg. 60288. HUD's final rule is the latest entry in a long line of interpretations of how the disparate impact theory applies under the Fair Housing Act.
