The Trump Administration is focused on reshaping the federal civil and administrative enforcement process. Federal regulatory agencies, including U.S. EPA and others, have been instructed to transition to a facilitated compliance model with a priority to more quickly resolve alleged noncompliance. Meanwhile, the Administration has embraced deregulation and emphasized strong partnerships with states with delegated programs. These efforts have created avenues for private parties to engage in their own enforcement actions at the state and even federal level, including citizens' suits under federal environmental laws. Deploying advanced pollution monitoring technology and crowd-sourcing evidence collection efforts, citizen groups have recently celebrated historically large settlements and have promised more litigation. This panel will evaluate this potential paradigm shift and offer insights and strategies for advising clients during a time of significant change in the federal regulatory enforcement process.
