    Ethics and Civility in an Uncivil Time [CC]

    Family Law's first-ever virtual CLE conference in October 2020 featured 20 hours of web-based CLE on a variety of family law and assisted reproductive technologies topics! We are pleased to offer the programs as on-demand CLE for those who may have missed registration for the live conference. This two-hour Ethics credit program explores what lawyers can do to help make the legal profession a more civil place when faced with incivility. Lawyers in any field of practice will find the discussion useful and thought-provoking.

    2 Hours Ethics CLE Credit

    Some think that our culture, and our interactions with each other, are coarsening. Yet, lawyers remain bound by various Rules of Professional Conduct and the inherent power of courts to sanction conduct that crosses the line. In this panel, we will discuss the rise of incivility, the ethics of incivility, and what good lawyers can do when pushed to make the world a harsher place, with a focus on ABA Model Rules 3.3 (Candor toward the Tribunal), 3.4 (Fairness to Opposing Party and Counsel), and 4.1 (Truthfulness in Statements to Others).

    At the end of this session, participants should be able to:
    •Understand strategies for alleviating incivility in the profession;
    •Identify how to engage in difficult conversations with clients and opposing counsel by understanding ABA Model Rule 3.4;
    •Recognize and know how to defuse highly charged situations by understanding ABA Model Rule 4.1; and
    •Know how to conduct a civil case, including in the courtroom, by understanding ABA Model Rule 3.3.
