Closed Captioned. These programs have been developed from content created for the 2020 Section of Family Law Spring CLE Conference. Join our expert panels as they provide valuable practice tips and updates on emerging topics in family law.
Program 1: Gathering Information Beyond Our Borders (1 Hour)
This panel will provide a synopsis of conducting discovery in international cases. Specifically, they will discuss how to go about seeking and collecting data from other countries needed to make your case and how to address the challenges presented when other nations refuse to cooperate with your requests.
At the end of this session, participants should be able to:
Understand that the standards to enforce discovery requests differ in every country. (In most countries, the requirement to cooperate with our discovery process is discretionary);
Recognize the importance of being familiar with the laws of the jurisdiction from which you seek information and know how to associate local counsel as early in the process as possible;
Understand that most countries require specific instructions and details regarding information requested in order to consider it "relevant;" and
Identify that there is more than one "Hague Convention" and be familiar with all of them.
Presenters:
Kathy S. Root, Esq., Gevurtz Menashe, Portland, OR (Moderator)
Jorge M. Cestero, Esq., B.C.S., Sasser, Cestero & Sasser, P.A., West Palm Beach, FL
Jason Naimi, Esq., Naimi & Cerceo, Las Vegas, NV
Program 2: The Icky Shuffle (of Assets): Recouping Marital Assets Transferred to Third Parties (1 Hour)
In family law cases, the impulse to protect property can lead parties to transfer assets to lovers, children, business partners, or other third parties. When that happens, what options are available to recover those assets? Can the non-transferring spouse seek relief directly from the third party or only from the transferring spouse? What procedures are available in family court (or outside of family court) to make the non-transferring spouse whole? Learn the answers to these important questions and more.
At the conclusion of this session, participants will be able to:
Identify the ways marital assets can be transferred to third parties;
Understand in what circumstances such transfers violate legal duties between spouses; and
Recognize what laws and procedures are available to the non-transferring spouse to recover the assets.
Presenters:
Natalie J. Murvin, CPA/CFF, Gursey Schneider LLP, Los Angeles, CA
