This program will consist of two parts. This second part will offer extended discussion of the applicability of the Sixth Amendment rights of confrontation and effective assistance of counsel.
This program will explore:
•What is the duty to preserve electronic information in criminal proceedings and sanctions that may be available for spoliation.
•Understand Rule 16.1 and its "meet-and-confer" obligation and how the prosecution and defense might "cooperate" in the production of electronic information
•How electronic information might be admitted into evidence.
