    State bar associations are often faced with appointing receivers to close out practices. This imposes tremendous burdens on the families, clients, and, especially attorneys appointed to clean up the mess left behind. How does that attorney / receiver find or obtain access to IOLTA accounts, determine client's case status, the location of important documents, and other financial matters?

    Under the Model Rule of Professional Conduct 1.3, “…[I]n the event of a sole practitioner’s death or disability…the duty of diligence may require…a plan…designat[ing] a competent lawyer…to protect the interests of clients of a diseased or disabled lawyer.

    Also, many solo and small-firm lawyers leave real value on the table when they close out their practices. Under Model Rule 1.17, you can sell your practice, including good will as long as certain conditions are satisfied.
