Though ABA Standards suggest that the modern practice should be diverting the mentally ill from criminal prosecution wherever possible, litigating competency is a necessary part of criminal practice. Mr. Arcidiacono and Ms. Murphrey both have years of experience litigating the issue of criminal competency in state court. Dr. Kavanaugh, a forensic clinical psychologist, has many years of experience providing case evaluation and consultation in juvenile, criminal, civil, and capital cases.
Topics will include the selection of experts, analysis of psychological evaluations, and presentation of testimony. The presenters will also discuss how to negotiate across the aisle in a way that is consistent with a prosecutor’s pursuit of justice and a defender’s obligation for vigorous client advocacy.
