On September 18, 2019, California Governor Gavin Newsom signed California Assembly Bill 5 (“AB 5”), codifying Dynamex Operations West, Inc. v. Superior Court of Los Angeles, 4 Cal. 5th 903 (2018), which set forth a three-part test in California in which all elements must be satisfied in order for a worker to be deemed an independent contractor instead of an employee.
