The panel also will offer guidance for effective Supreme Court briefing and oral argument. The Court is uniquely positioned to construe (and may overturn) its own precedent, and its decisions represent the final word nationally on constitutional questions. Meanwhile, oral argument in the Court is extraordinarily active, requiring advocates to present many of their affirmative points in the form of answers to questions from the bench. The panel will discuss these and other attributes of Supreme Court litigation and their implications for effective advocacy.
