While emails and text messages have been common forms of evidence for the better part of two decades, emojis, emoticons and hashtags are just starting to make their way into evidence (or, maybe not) as more and more people use them as a form of expression, and in replace of actual words. As emojis continue to be increasingly used, and interpreted by the courts, it is important that lawyers be aware of their import, whether it be at trial, or in the workplace, so that they can best advise and represent their clients on issues relating to emojis.
