    A transactional music attorney, a copyright litigator, a musicologist, and a veteran songwriter will discuss the current state of the law regarding music copyright infringement and what songwriters and other music industry players should consider throughout the creative process of making and distributing music. The panel will review last year's 9th Circuit decisions in the Skidmore v. Led Zeppelin ("Stairway to Heaven") and Williams v. Gaye ("Blurred Lines") cases, the pending case by Ed Townsend's estate against Ed Sheeran, and the effect this flurry of copyright infringement cases is having on the legal industry and the songwriting process. The panel will also discuss the Supreme Court case Fourth Estate Public Benefit v. WallStreet.com, which finally will resolve whether a copyright registration must be obtained prior to an infringement action being filed.

    Issues that will be covered include the current state of "substantial similarity" and "originality" in copyright law; the importance of deposit copies, especially in pre-1978 copyright registrations; the role of jury instructions in infringement trials; and the role of musicologists in trials as well as in consulting during the creative process and pre-trial. Emphasis will be placed on providing useful information for the practicing attorney who must advise creative professionals on how to effectively protect musical works and avoid or deal with infringement claims in the creative process.
