After the recent tragic shootings, everyone is thinking differently about security measures. Some industry experts are sharing suggestions for metal detectors, video cameras, bomb-sniffing dogs, window shatter sensors and other measures that theoretically could have prevented the horrific incidents. But this trend directly challenges many hospitality and retail companies' long-standing commitments to guest privacy and service. For many hotel guests, the "Do Not Disturb" sign is as much a part of a guest's expectations as a clean bed and a warm shower. And for many retail customers, carrying their other packages into a store or trying items on in a private dressing room is essential.

How much privacy and convenience would and should guests be willing to give up to increase security? What will be deemed "reasonable" security in the 20/20 hindsight of a jury when another shooting happens? These questions, as illuminated by current case law regarding liability theories and the franchisor-franchisee relationship, will be discussed in this program.

    Faculty will:

    • Discuss the latest issues in security response to the mass shooting risk
    • Review key legal developments in the areas of premises and vicarious liability
    • Formulate strategies for addressing security policy changes and claim resolution
