    Join our expert faculty members, including a state disciplinary counsel, as they discuss the various issues, including the unique challenges to the decision-making paradigm when representing clients in a legalized marijuana business while the product is still a crime to possess, distribute, or sell in large quantities based on federal law.

    Specifically, the panelists will discuss how lawyers need to navigate the Model Rules of Professional Conduct that are implicated, including MRPC 1.2(d) and its differing state companions as well as other affected rules such as MRPC 1.15 (trust accounting), R. 2.1, R. 5.1, R. 5.2, and R. 8.4(a), (b), (d), and (g) (those jurisdictions which have (g)).

    For example, MRPC 1.2(d) prohibits a lawyer from counseling, engaging, or assisting a client in conduct she knows to be criminal in nature. Some states, such as Colorado, have enacted changes to the Comment to this rule. Other states have changed Rule 1.2 although this can be a problem to get approved by a state's Supreme Court.

    This program will illustrate the differing laws around the country regarding marijuana as well as differing ethics opinions; how lawyers with multi-jurisdictional practices are affected; problems to avoid; fact patterns and scenarios commonly encountered; and issues with malpractice arising out of this new and growing area of the law.
