    The legal profession is under intense pressure from both domestic and international sources to implement effective risk-based measures to prevent money laundering and terrorist financing. Lawyers involved in all types of financial transactions should thus assess the money laundering and terrorist financing risk their clients present. In August 2010, the ABA House of Delegates adopted “Voluntary Good Practices Guidance for Lawyers to Detect and Combat Money Laundering and Terrorist Financing." In 2014, the Standing Committee on Ethics and Professional Responsibility adopted Formal Opinion 463 that encourages lawyers to use the Voluntary Good Practices as they are consistent with the Model Rules of Professional Conduct.

    By implementing the risk-based control measures detailed in the Voluntary Good Practices, lawyers can avoid aiding illegal activities. Lawyers, clients and the public benefit from these Voluntary Good Practices. Equally important, participation in the Voluntary Good Practices will help avoid imposition of mandatory federal regulations on the legal profession.
