What Every Lawyer Should Know About Judicial Speech in a Politically Polarized Environment (On-Demand CLE)

Harsh, politically-charged speech appears to rule the day without a filter and with an intent to drown out opposing views. Statesmanship seems to be a lost art. Name-calling, labeling, and branding fill communication mediums and have become a substitute for debate and persuasive speech. But how does this type of speech pertain to pleadings and briefs, correspondence, oral argument, written orders, and courtroom colloquy? This webinar will provide you with an an update on the future of regulated lawyer and judicial speech and specific cases of disciplined lawyers.

In this program, panelists will discuss vitriolic speech as it pertains to pleadings and briefs, correspondence, oral argument, written orders, and courtroom colloquy. Specific cases of disciplined lawyer and judicial speech will be addressed. The future of regulated lawyer and judicial speech will close out the presentation.

Questions that will be addressed include:
      • Whether or not there is a societal permissiveness to be “old school” and tell it like it is
      • Is political and adversarial discourse more strident today, or is it static, but subject to greater exposure via 24 hour cable news, satellite radio, internet and social media?
      • Are lawyers and judges becoming emboldened to tilt their communications to the vernacular of the day?
