Social Media and Web-Content Evidence for Personal Injury Litigators: Preservation and Admission of ESI (On-Demand CLE)

If you practice personal injury law, you know that web content such as social media or personal blog content can win or lose a case. Clients claiming, they cannot walk, only to post videos of themselves dancing. Defendants claiming, they weren't using their phones, only to have posted on Facebook seconds before a crash. Given the value of this evidence, no matter whether you serve as plaintiff or defense counsel, it is critical that you understand how to properly preserve and produce this web content. During this program, our knowledgeable faculty will offer a wide range of range of evidence for preservation of web-based content.

Web content must be relevant, probative and authenticatable in order to be admitted. Proving who wrote valuable content isn't as easy as saying the witness owned the account. Various states require different levels of evidence, some more challenging than others.

You will also explore the steps needed to authenticate that content for use in court. Panelists include an ethics lawyer employed by a personal injury firm, who both preserves and uses web-based evidence to prove her firm’s cases and a digital forensics technologist who is accustomed to routinely preserving web pages using various tools.
