Fundamentals of the Health Care Quality Improvement Act (On-Demand CLE)

The Health Care Quality Improvement Act's (HCQIA) immunity provisions have been expansively interpreted and applied by the courts, significantly benefiting peer-reviewed physicians, but as the stakes surrounding physician credentialing have risen, the responses from healthcare providers to adverse credentialing actions have escalated. Whether your clients are physicians benefiting from the HCQIA or healthcare providers seeking to jump over the immunity hurdle, you need to hear what our panel of HCQIA experts have to say.

This program will provide an overview of the Health Care Quality Improvement Act (HCQIA), a federal statute that 1) provides immunity from damages liability for hospitals, administrators, physicians and others who participate in medical peer review if certain due process and other criteria are met; and 2) requires hospitals and certain other entities to report to the National Practitioner Data Bank adverse actions against a physician's clinical privileges. A substantial body of case law has evolved since the HCQIA came into effect in 1986. Faculty will discuss the multiple provisions of the statute, and how it has been interpreted and applied by the courts.

    Topics will include:
    • Immunity from money damages for peer review activities and actions
    • Immunity from money damages for filing mandated reports with the Data Bank
    • Significant court rulings
