The protection of an artistic feature of a useful article has been a source of confusion and inconsistent court decisions for decades, until now. For the first time, the U.S. Supreme Court ruled on copyright protection for apparel. The Supreme Court affirmed the August 2015 ruling by the U.S. Circuit Court of Appeals for the Sixth Circuit in Star Athletica, LLC v. Varsity Brands, Inc., and affirmed that two-dimensional graphic designs are entitled to copyright protection as "pictorial, graphic, and sculptural works" under the copyright law for useful articles under certain circumstances.

In this program, you'll hear from experts with the U.S. Copyright Office and the Fashion Law Institute of Fordham Law School as they discuss the Supreme Court's recent decision and its impact on the fashion industry and the protection of useful articles.

    Other topics will include:
    • The U.S. Supreme Court's new standard for registrability of "useful articles" under copyright law
    • Applying this standard in legal practice to registration, enforcement, and defense against claims involving "useful articles" in a wide range of industries
